US Judge Orders Freedom of Abrego Garcia from ICE Detention
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks lawful basis.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.
The situation originates in a erroneous removal to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to face alien smuggling allegations, he was held in immigration detention.
In her decision, the court noted that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
Context of the Legal Challenge
The legal proceedings involve disputed claims. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
He has also entered a not guilty plea to the conspiracy charges, which are part of a separate trial in Tennessee.
Terms of Freedom
The judge, who was hearing his challenge to removal in a federal court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
This decision marks a notable development in a complicated immigration case featuring claims of wrongful detention and contested gang associations.
