The ex-lawyer for the former president has left her position as the chief federal prosecutor in the state. This follows a court battle that questioned her legal standing to occupy the role.

Official Departure

The head of the Justice Department, the Attorney General, accepted the prosecutor's departure on the start of the week. She commented that the appeals court finding made it unworkable for her to perform her duties.

"Do not interpret compliance for surrender," she wrote. "The effort will now reach across America."

Court Ruling

Her resignation comes a week after a US appeals court found that she had been acting without proper authority as US attorney. This decision is likely to affect numerous legal proceedings in the Garden State.

The appellate judges declared that a interim role that bypassed Senate approval violated the statute on vacant positions.

Ongoing Legal Battle

The Attorney General added that Habba will remain at the DOJ as a top consultant. They intend to challenge the decision of the ruling, aiming for a different outcome.

In a statement, Bondi contended that the court "must not override the appointment of attorneys responsible for executing the executive branch's core responsibility of criminal prosecution."

Performance in Office

She highlighted the prosecutor's work and said that while she was in charge, the city of Newark saw a significant drop in offenses. It was also reported that the city of Camden recorded its first summer in half a century free from homicides.

Background and Previous Role

Habba, was initially recruited to Donald Trump's lawyers in recent years. She later acted for her client in his hush-money trial in 2024, which resulted in his conviction on multiple felony counts of falsifying business records.

Earlier, her appointment to the federal prosecutor position, Donald Trump had stated he was selecting her as his senior adviser during his second administration, calling Habba as deeply loyal and a dedicated fighter for justice.
